1Agreement to these Terms
By creating a handle, paying the entry fee, or otherwise using VYRKAITO (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and the Official Rules and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the Service.
You must accept these Terms and the restricted-country notice before payment. Acceptance is recorded with a timestamp.
2Nature of the Service — please read carefully
2.1VYRKAITO operates a skill-based trading competition. Contestants use a simulated balance to trade real market prices over a fixed contest window. Rankings are determined by trading performance.
2.2The simulated balance is not real money. At the start of a contest you are issued 10,000 virtual USDT. This balance has no cash value, cannot be withdrawn, transferred, sold, or exchanged, and exists only to score the competition. No real customer funds are ever traded in the simulator.
2.3This is not investment advice or a financial product. Nothing in the Service is a recommendation to buy, sell, or hold any asset. We are not a broker, exchange, investment adviser, or money-services business acting on your funds. Past performance in a contest means nothing for real markets.
2.4You are not trading real crypto and cannot lose or gain real crypto through gameplay. Your only financial outlay is the entry fee (Section 4); your only financial gain is the fixed prize if you win (Section 5).
3Eligibility
3.1You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher).
3.2You must not be located in, or a resident of, any Restricted Territory listed in the Official Rules, nor any country subject to applicable sanctions. We may use geolocation and other signals to enforce this and may refuse or void entries accordingly.
3.3One person may hold one account and enter each contest once. Multiple accounts, shared accounts, and entries on behalf of others are prohibited.
3.4You are solely responsible for ensuring that participation is lawful where you live. If it is not, do not participate.
4Entry Fee — Non-Refundable
4.1The entry fee is a fixed 10 USDT per contestant, paid once per contest via the approved payment method and blockchain network only.
4.2All entry fees are final and non-refundable. Once you have paid and/or begun participating in a contest, your entry fee will not be refunded under any circumstances, including but not limited to: elimination, poor performance, disqualification for rule violations, voluntary withdrawal, loss of internet connectivity, device failure, or dissatisfaction with the Service.
4.3Exceptions handled outside gameplay. Payments that are the wrong amount, sent on the wrong network, sent to an expired or reused invoice, duplicated, or otherwise not a single valid confirmed entry payment do not create a valid contest seat. Such payments are handled under our written payment-resolution policy and, where we are able and required to do so, may be returned net of network costs. This is an operational correction of an invalid payment — it is not a refund of a valid entry.
4.4One confirmed entry payment creates one contest seat. Paying more than once does not grant extra balance, extra entries, or any advantage.
5The Prize — Winner Takes All
5.1The prize is a fixed 1,000 USDT, awarded to the single first-place finisher of each contest, funded from a separate company prize wallet.
5.2Only the first-place winner receives a prize. No prizes, consolation, partial payouts, or fee returns are given to any other contestant, regardless of rank or performance.
5.3The prize amount is fixed and is not calculated from, or dependent on, the number of entrants or the total entry fees collected. The prize is paid even if fewer than ten contestants enter.
5.4Conditions of payout: passing identity verification (KYC) where required; not being flagged for any rule violation, cheating, collusion, or abuse; providing a valid payout address on a signed, authenticated screen; and completing our risk-review process. We may withhold, delay, or forfeit a prize pending investigation of suspected violations.
5.5Winners are solely responsible for any taxes arising from the prize. We may collect tax information and withhold amounts where required by law.
6Contest Rules and Mechanics
6.1Each contest runs for a fixed period of 12 hours with a single shared simulator. Rules including starting balance (10,000 virtual USDT), elimination at 9,000 equity (a 10% maximum-loss rule), position and leverage limits, fees, slippage, funding, one-net-direction-per-symbol, and a reduce/close-only final window are set out in the Official Rules and enforced by the server.
6.2The server is the sole authority. All prices, profit/loss, rankings, eliminations, and results are calculated on our servers. In the event of any discrepancy between what your device shows and what our server records, the server record is final and binding.
6.3We may pause, reschedule, shorten, extend, void, or cancel a contest where necessary for technical, security, legal, or integrity reasons.
6.4The leaderboard is limited, delayed, and frozen as described in the Official Rules. We do not disclose total entrant counts, total deposits, or hidden rankings.
7Fair Play, Anti-Cheat, and Disqualification
You agree not to: operate multiple or fake accounts; collude, mirror-trade, or coordinate with other contestants; use bots, scripts, automation, or any tool to place or time orders; exploit bugs, latency, stale prices, or price-feed conditions; tamper with the client, API, tokens, or network traffic; or attempt to manipulate the leaderboard, settlement, or payout.
We employ automated and manual anti-abuse systems. Suspected violations may result in an abuse flag, account suspension, entry voiding, disqualification without refund, prize forfeiture, and referral to authorities where warranted.
Our determinations on fair play are made in good faith and, absent manifest error, are final.
8Accounts, Handles, and Avatars
8.1You are responsible for your account, your access credentials, and all activity under your account. Notify us immediately of any unauthorized use.
8.2You must choose a handle that is not offensive, misleading, infringing, or impersonating. We may reclaim or change handles that violate this.
8.3Avatars are generated automatically by us from server-side components. We own all rights in generated avatars and all VYRKAITO branding, software, designs, and content. You receive a limited, revocable licence to use your assigned avatar solely within the Service.
9Disclaimer — Technical Issues & No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, UNINTERRUPTED OR ERROR-FREE OPERATION, AND NON-INFRINGEMENT.
We are not responsible for any glitch, bug, lag, freeze, display error, or malfunction in the trading panel or Service while you are trading, nor for any resulting effect on your positions, equity, ranking, elimination, or result.
You accept these risks as an inherent part of a live, timed, internet-based competition. You are responsible for your own device, connectivity, and environment.
10Intellectual Property
All software, source code, engine logic, designs, text, graphics, avatar systems, trademarks, and the VYRKAITO name and brand are owned by us or our licensors and are protected by law. You receive only a limited, personal, non-transferable, revocable licence to use the Service for participation.
11Limitation of Liability
11.1To the maximum extent permitted by law, we and our officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or opportunity, arising from or related to the Service.
11.2To the maximum extent permitted by law, our total aggregate liability to you for any and all claims relating to the Service shall not exceed the amount of the entry fee you actually paid for the contest giving rise to the claim.
11.3These limits apply regardless of the legal theory and even if we were advised of the possibility of such damages.
12Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
13Suspension and Termination
We may suspend or terminate your access at any time for breach of these Terms, suspected fraud or abuse, or legal/security reasons. Sections that by their nature should survive (including 2, 4, 5, 7, 9, 10, 11, 12, 15) survive termination.
14Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance. The version in force for a given contest is the version you accepted when you entered it.
15Severability and Entire Agreement
If any provision is held unenforceable, the rest remains in effect. These Terms, together with the Official Rules and Privacy Policy, are the entire agreement between you and us regarding the Service.
